Small Claims Process and Procedure

This is the process of direct contact with your lender, the exhaustion of their complaints process, and the forwarding of the claim to the Financial Ombudsman Service.

Only after the unsuccessful pursuit of these services can you refer your claim to court in order to use the Small Claims Track.

As the claimant you start your claim by completing the necessary claim form. This form is openly available from our affiliate site, from local courts or Her Majesty’s Courts Service website.

This claim form will ask for your personal details and the lenders, and details of how much money is being claimed. The form includes a section for the particulars of your claim, this is where you should provide as much information and evidence as possible.

Upon receiving your form and details the court will usually serve the claim to your lender through post on an (agreed by you) online service.
